Terms of Service
The terms covering use of the Focal image processing and delivery service.
Who you are contracting with
These terms cover use of Focal, the service at focaltool.com, and nothing else. Dodo Payments is the merchant of record for every subscription, and the operator's registered details appear on the invoice it issues you.
What the service does
Focal reads images from an origin you control, transforms them according to parameters in the request URL, and delivers the result from a cache. It never writes to your origin and never takes custody of your original files.
Subscription and billing
Plans are priced by worker tier in US dollars and billed monthly in advance. Your worker tier sets how many images Focal processes at the same time for your account. Transformations are not metered. Bandwidth is included under the fair use terms below.
Free trial
The 8-worker plan comes with a 14-day free trial. Other plans have no trial, and we charge for them at checkout. A new account can start the trial on its first subscription. The trial requires a card, which you add at checkout. We charge that card for the first month when the trial ends, unless you cancel before then. Each account gets one trial, and later subscriptions on the same account start without one.
Fair use of bandwidth
Bandwidth is included in every plan under fair use, with no monthly allowance and no overage charge. Fair use means delivering images to the visitors of your own sites and apps. It excludes using Focal as a general file host, for example to serve downloads, video or other files that are not images. If your usage falls outside fair use, we will contact you about a plan that fits.
Taxes
Prices exclude tax. Dodo Payments acts as merchant of record for Focal subscriptions and calculates and collects any applicable sales tax, VAT or GST at checkout, so the amount shown before payment is the amount charged.
Your images
You keep every right in the images Focal processes. We store transformed derivatives in cache for delivery, and cached copies are purged on request or when the cache expires. We do not inspect, index, resell or train models on your images.
Acceptable use
Focal may not be used to process unlawful material, or to proxy media you have no right to distribute. Accounts that do either may be suspended. Automated traffic that degrades the service for others may be rate limited.
Availability
Focal carries no contractual uptime commitment unless one is agreed in writing. We will give notice before this changes.
Suspension and termination
You may cancel at any time from the dashboard. We may suspend an account for non-payment after written notice, or immediately for the acceptable-use breaches above. On termination, delivery stops and cached derivatives are purged; your originals are untouched because they were never ours.
Warranties and liability
The service is provided without implied warranties beyond those the law requires. Aggregate liability is capped at the fees paid in the three months preceding the claim.
Changes to these terms
Material changes are announced by email to the address on the account at least 30 days before they take effect. Continuing to use Focal after that date accepts them.
Governing law
Indian law applies, and the courts of competent jurisdiction in India have exclusive jurisdiction over any dispute arising from these terms.
